[link]let them know that we are against this monstrocity!
it has come to my attention that many people are misinformed about the orphan act.many seem to think that it has been amended and is now safe. this however is not the case.it has been made worse.oe of the major amendmants was to place a capped fee on the amount you are allowed to sue for. the suggested price being $200 american dollars.that means that a huge corporation can steal my work make millions and only pay me $200 dollars (suggested)!read here:
[link]you would not be entitled to attorneys fees or court costs and they can continue to use your work even after you emerged and sued!.this is all from the latest version of the orphan act.they can also just slightly tweek your work and claim ownership. dont be fooled its a bad thing.
this is what is in the acctuall bill:
"
"If the owner emerges after the use has commenced, the users liability should be limited.
The user would only be required to pay to an emerging owner a fee capped at a maximum amount; for example: $200.
A court would not give an injunction against the use of the work.
In case of web-based uses, the user would not be required to take down the work.
The owner would not be entitled to attorneys fees or statutory damages."
